When the plan has not paid the selected offer, less the initial payment and cost sharing, within 30 calendar days after the certified IDR entity’s determination, under 45 CFR 149.510.

What can a provider do about an unpaid IDR award?

Unpaid awards can be reported to the No Surprises Help Desk, and HHS may impose civil money penalties under 42 U.S.C. 300gg-22. Whether a provider can also sue depends on the court; the Fifth and Second Circuits say no. Choosing a route is a decision for counsel; tracking supplies the dated record.

Will the new CARC/RARC codes help track IDR payments?

The 2026 Federal IDR Operations rule requires plans to use specified CARC and RARC codes on remittance advice to out-of-network providers. Under July 17, 2026 guidance, this applies to services furnished from January 1, 2027. Where the codes are present, tracking captures them.
